1. Acceptance of Terms

By accessing or using Notifer ("Service"), provided by NexoLab Igor Barkowski based in Gdańsk, Poland ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you agree to these Terms for that organization.

2. Description of Service and Technical Requirements

Notifer is an HTTP-based pub-sub notification service.

Requirements: To use the Service, you need:

  • A device with an internet connection
  • A modern web browser (e.g., Chrome, Firefox, Safari, Edge – latest 2 versions)
  • And/or a mobile device running iOS or Android with the official Notifer app

Service "As Is": While we strive for perfection, the Service is provided "as is" and "as available".

3. Account Registration

Eligibility: You must be at least 16 years old.

Accuracy: You must provide a valid email address and keep your credentials secure. You are responsible for all activity under your account.

4. Subscription Plans and Payments

Reseller Model: All payments are processed by Paddle.com (our Merchant of Record). Paddle is responsible for billing, tax collection (VAT/Sales Tax), and payment-related customer support.

14-Day Right of Withdrawal (EU/UK Consumers): If you are a consumer in the EU, UK, or other jurisdictions providing such rights, you have the right to cancel your initial subscription within 14 days of purchase for a full refund.

Auto-Renewal: Subscriptions renew automatically unless cancelled via account settings or through Paddle.net.

5. Acceptable Use Policy (AUP)

You may not use Notifer for:

  • Spam & Abuse: Unsolicited bulk messaging or harassment.
  • Illegal Acts: Content that violates local or international laws.
  • Malware: Distributing viruses or harmful code.
  • Sensitive Data: Sending unencrypted credit card numbers, passwords, or sensitive health records.
  • System Abuse: Intentional actions to degrade service performance (e.g., DDoS).

6. Intellectual Property & DMCA

Your Content: You retain ownership of your messages. You grant us a worldwide, limited license to process, store, and transmit your content solely to provide the Service.

DMCA (U.S. Users): If you believe content on our Service infringes your copyright, send a notice to support@notifer.io including: (i) your signature, (ii) description of the work, (iii) location of the infringing material, and (iv) your contact info.

7. Data Privacy

Our processing of personal data is governed by our Privacy Policy, which is compliant with GDPR (EU). We do not sell your data. Message history is stored temporarily (up to 60 days) and then permanently deleted.

8. Service Availability & Inactive Topics

Uptime Target: We aim for 99.5% uptime for paid plans.

Inactivity Deletion: To optimize resources, inactive topics (no messages sent) will be deleted after:

  • Free: 7 days
  • Essentials: 30 days
  • Team: 60 days

Notifications: We will attempt to notify you via email/app before deletion.

9. Limitation of Liability

General: To the maximum extent permitted by law, Notifer shall not be liable for any indirect, incidental, or consequential damages, or loss of profits/data.

Cap on Liability: Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the event (or €100 for free users).

Consumer Rights: Nothing in these Terms affects your statutory rights as a consumer that cannot be waived by contract.

10. Export Control & Sanctions

You represent and warrant that:

  • You are not located in a country subject to a U.S., UK, or EU government embargo (e.g., North Korea, Iran, Crimea, etc.).
  • You are not on any list of prohibited or restricted parties (e.g., OFAC Specially Designated Nationals).

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Poland and the European Union, without regard to conflict of law principles.

11.2 Binding Arbitration (U.S. Users Only)

If you reside in the United States, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). You waive your right to a trial by jury.

11.3 Class Action Waiver

All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

11.4 Jurisdiction (Non-U.S. Users)

Subject to Section 11.2, any disputes will be resolved in the courts of Gdańsk, Poland. Consumers in the EU may also use the EU Online Dispute Resolution platform or file claims in their country of residence if local law requires it.

12. Termination

By You: You can delete your account at any time.

By Us: We may suspend or terminate access for violations of the AUP, non-payment, or legal requirements.

13. Changes to Terms

We may modify these Terms at any time. For material changes:

  • We will provide at least 30 days' notice via email or app notification
  • You will be required to accept the updated Terms in the application to continue using the Service
  • If you do not accept the updated Terms, you may terminate your account before the changes take effect

For non-material changes (e.g., clarifications, typo fixes), continued use after the notice period constitutes acceptance.
